The system was not just flawed. It was unlawful from the start.
What makes Robodebt particularly instructive is not its technical complexity. The algorithm itself was relatively simple, averaging tax office data to match welfare payments. The catastrophe emerged from something more insidious: the deployment of automated systems without adequate human oversight, transparency, or ethical consideration. As the Royal Commission noted, the failure was sustained by poor culture, including lack of accountability and what they memorably described as "venality, incompetence and cowardice."
Here we confront a larger truth: digital technologies are reshaping our societies and civilisational foundations at a breathtaking pace. The paradox is that software development has long proceeded without robust and systematic integration of ethical reflection. The federal government has released its national AI plan, promising an inclusive AI economy while notably avoiding mandatory guardrails for high-risk AI applications. Instead, the government argues that existing legal frameworks are sufficient, with minor changes managed through a new AI Safety Institute. This approach prioritises making Australia attractive for international data centre investment over robust protection for citizens and businesses.
